Notice is hereby given that on Thursday, August 13, 2020 at 7:00 p.m., a public hearing will be held by the Board of Zoning, Building and Housing Appeals (BZA) for the City of Miamisburg, Ohio on an application, being Case No. BZ-03-2020, a request by the property owner of 61 S. Main Street for approval under Section 1234.03(f) of the Planning and Zoning Code for the continuation of an approved temporary use for an outdoor seating area on the rear (west side) of the property located at 61 S. Main Street otherwise known as Goodtime Charlie’s. The applicant is also requesting a variance to the requirements of 1234.03(f) that limit the duration such temporary uses to twelve months.

NOTE: Due to the current situation with the COVID-19 Pandemic and pursuant to Ohio HB 197, this BZA meeting will be held virtually and will be hosted on Zoom and streamed on public access cable (Channel 5) and on the Miami Valley Communications Council (MVCC) website.

Notice is hereby given that on Thursday, August 13, 2020 at 7:00 p.m., a public hearing will be held by the Board of Zoning, Building and Housing Appeals (BZA) for the City of Miamisburg, Ohio on an application, being Case No. BZ-04-2020, a request by the property owner of 1386 Hidden Creek Drive, Miamisburg, OH 45342 for approval of variances to the requirements of Section 1289.04(e) of the Planning and Zoning Code to allow for the installation of a 6’ privacy fence in the “front yard” (toward Benner Road) on the south side of the property. Per Section 1289.04(e), perimeter fences are not permitted in front yard areas.

Notice is hereby given that on Thursday, August 13, 2020 at 7:00 p.m., a public hearing will be held by the Board of Zoning, Building and Housing Appeals (BZA) for the City of Miamisburg, Ohio on an application, being Case No. BZ-05-2020, a request by the property owner of 439 E. Linden Avenue, Miamisburg, OH 45342 for approval of a variance to the requirements of Section 1289.07(b) of the Planning and Zoning Code to allow for the construction of a detached accessory structure that exceeds the maximum allowable size. The property owner intends to demolish the existing carriage house and carport and construct a new enclosed garage that will measure 864 sq. ft. (24’ deep by 36’ wide) in size in the rear yard of the property.

Notice is hereby given that on Thursday, August 13, 2020 at 7:00 p.m., a public hearing will be held by the Board of Zoning, Building and Housing Appeals (BZA) for the City of Miamisburg, Ohio on an application, being Case No. BZ-06-2020, a request by the property owner of 1222 Opal Avenue, Miamisburg, OH 45342 for approval of variances to the requirements of Sections 1289.04(e) and1289.05(b)  of the Planning and Zoning Code to allow for the installation of a swimming pool and 6’ tall privacy fence in the side yard of the property on the north side of the house. Per Section 1289.04(e), fences located within side yards must be at least 50% “open” and can be no taller than 4’ in height. Also, per Section 1289.05(b), swimming pools are limited to rear yard and corner side yard areas.
