Notice is hereby given that a Public Hearing will be held by the Planning Commission of the City of Miamisburg on Monday, February 22, 2021 at 6:00 p.m. to consider an application for a Special Use Permit, (Case #SU 04-2020) for the review of a proposed daycare/childcare use (Creative Children of Promise) at 1216 Richard Street, Miamisburg, OH 45342. The subject property currently includes a church (Miamisburg First Church of the Nazarene) and is zoned R-1 (Residential). Child care centers, nursery schools, and day nurseries are permitted as Special Uses in the R-1 zoning district when conducted within an existing church or nonprofit educational institution when reviewed and approved by the Planning Commission through a public hearing process.

Notice is hereby given that a Public Hearing will be held by the City Council of the City of Miamisburg on Tuesday, February 16, 2021 at 6:00 p.m. to consider the following ordinance:

AN ORDINANCE TO AMEND AND SUPPLEMENT VARIOUS CHAPTERS OF THE PLANNING AND ZONING CODE OF THE CITY OF MIAMISBURG IN ORDER TO UPDATE VARIOUS DEFINITIONS, TO UPDATE HOME OCCUPATION AND OTHER DESIGN STANDARDS, RESIDENTIAL CONVERSION STANDARDS, PLANNED DEVELOPMENT STANDARDS, VARIOUS USE LISTS, AND PARKING STANDARDS.

This ordinance amends several sections of the Planning and Zoning Code. These amendments include updates to the use lists of the R-1, R-2, R-3, R-4, NB-1, CBD-1, CSD-1, and MB-1 Zoning Districts, updates to the minimum parking and drive aisle size requirements, updates to the site design standards for home occupations and microbreweries/microwineries/brewpubs, and updates to various definitions in the Planning and Zoning Code. During the Planning Commission’s public hearing on this item on 1/25/2021, the Planning Commission suggested a few changes to the wording of the City’s planned development regulations, which resulted in amendments to the ordinance.

AN ORDINANCE TO REZONE CITY LOT, PARCEL ID K46 00718 0073 OF THE CITY OF MIAMISBURG, FROM THE CURRENT ZONING DESIGNATIONS OF RO-1 (RESEARCH OFFICE) AND I-1 (LIGHT INDUSTRIAL) TO SDD-1 (SPECIAL DEVELOPMENT DISTRICT) AND TO APPROVE THE COMPANION PRELIMINARY DEVELOPMENT PLAN FOR THE POST-ACUTE MEDICAL REHABILITATION DEVELOPMENT.

This ordinance approves the rezoning from Research Office (RO-1) and Light Industrial (I-1) to Special Development District (SDD-1) of the vacant 5.15-acre property (parcel ID: K46 00718 0073) located at the southeast corner of the intersection of Alexandersville Road and Crosspointe Drive. This ordinance also approves the associated preliminary development plan for the property. The purpose of this rezoning is to allow for the construction of a post-acute medical hospital on the property.

Notice is hereby given that on Monday, February 8, 2021 at 7:00 p.m., a public hearing will be held by the Board of Zoning, Building and Housing Appeals (BZA) for the City of Miamisburg, Ohio on an application, being Case No. BZ-09-2020, a request for variances to the requirements of Section 1289.04(e) of the Planning and Zoning Code to allow for the installation of a 6’ tall privacy fence in the side yard on the west side of the property at 1226 McKinley Court, Miamisburg, OH 45342. Per Section 1289.04(e)(1)(C), perimeter fences are limited to 48” in height and must be at least fifty percent “open” when located within side yard areas.

Notice is hereby given that on Monday, February 8, 2021 at 7:00 p.m., a public hearing will be held by the Board of Zoning, Building and Housing Appeals (BZA) for the City of Miamisburg, Ohio on an application, being Case No. BZ-08-2020, a request by the property owner of 2003 Leis Road, Miamisburg, OH 45342 for approval of variances to the requirements of Section 1289.04(e) of the Planning and Zoning Code to allow for the installation of a 5’ privacy fence in the “front yard” (toward Gebhart Church Road) on the west side of the property and in the “corner side yard” on the north side of the house and in the side yard on the east side of the house. Per Section 1289.04(e), perimeter fences are not permitted in front yard areas and such fences are limited to 48” in height within side and certain corner-side yard areas.

Notice is hereby given that on Monday, February 8, 2021 at 7:00 p.m., a public hearing will be held by the Board of Zoning, Building and Housing Appeals (BZA) for the City of Miamisburg, Ohio on an application, being Case No. BZ-07-2020. This application involves two requests; first a variance request to Section 1242.04(a) of the Planning and Zoning Code which requires a minimum rear yard setback of 40’ for principal structures in the R-1 (Residential) District. The purpose of this variance request is to allow for the construction of a new single-family home on a proposed lot that would sit closer to the rear lot line than the 40’ minimum prescribed by the Planning and Zoning Code.

The second appeal is an administrative appeal filed under Section 1236.02(b)(1) of the Planning and Zoning Code to appeal the decision by the Zoning Official regarding the interpretation of the “Lot Frontage” and “Lot Width” definitions within Chapter 1230 of the Planning and Zoning Code. The purpose of this appeal is to allow for the splitting of the property (1319 Meadowview Avenue, Miamisburg, OH 45342) located at the southern end of Meadowview Drive.

Should the BZA choose to uphold the Zoning Official’s interpretation of the “Lot Frontage” and “Lot Width” definitions as they relate to parcels located along cul-de-sacs, then the applicant is also requesting a variance to the requirement of Section 1242.03(a)(2) of the Planning and Zoning Code that requires minimum lot frontages (length of the lot directly abutting a public street right-of-way) to measure 90’ in length. The purpose of this request is to allow the lot at 1319 Meadowview, Miamisburg, OH 45342 to be split into two lots. In the case of 1319 Meadowview, the existing frontage is 50’, which means a variance to the 90’ standard will be required for the property owner to split the lot.
