AN ORDINANCE TO REZONE CITY LOTS, PARCEL IDS K46 01004 0007 AND K46 00718 0025 OF THE CITY OF MIAMISBURG FROM THE CURRENT ZONING DESIGNATIONS OF HS-1 (HIGHWAY SERVICE) AND OS-1 (OFFICE SERVICE) TO SDD-1 (SPECIAL DEVELOPMENT DISTRICT) AND TO APPROVE THE COMPANION PRELIMINARY DEVELOPMENT PLAN FOR THE CASTRUCCI AUTOMALL DEVELOPMENT.

This ordinance approves the Preliminary Development Plan for the proposed Castrucci Automall Development proposed to be located at 490 Byers Road, Miamisburg, OH 45342. This site is located on the northeast corner of the intersection of Byers Road and Lyons Road. The property is comprised of approximately 38 acres of land; ~30 acres of which are proposed to be developed as an automall (4 car dealership buildings and a body shop) while the remaining ~7.4 acres would be rezoned for future office and light-industrial uses.

AN ORDINANCE TO REZONE CITY LOTS, PARCEL IDS K46 01422 0009, K46 01422 0023, K46 01422 0024, K46 01422 0025 AND K46 01422 0026 OF THE CITY OF MIAMISBURG FROM THE CURRENT ZONING DESIGNATIONS OF A (AGRICULTURAL, MIAMI TOWNSHIP ZONING) AND PR (PLANNED RESIDENTIAL) TO PR (PLANNED RESIDENTIAL) AND TO APPROVE THE COMPANION PRELIMINARY DEVELOPMENT PLAN FOR THE COURSEVIEW AT PIPESTONE PLANNED RESIDENTIAL SUBDIVISION.

This ordinance approves the Preliminary Development Plan for the proposed Courseview at PipeStone subdivision proposed to be located at 9547 Miamisburg-Springboro Road, Miamisburg, OH 45342 near the intersection of Medlar Road and Miamisburg-Springboro Road and southwest of the PipeStone Golf Course. This proposed development would include the development of approximately 43 acres of land into 127 single-family residential lots.

A mixture of “Lifestyle” (single-story, age-targeted) and “Traditional” (predominately two-story, non-age-targeted) housing unit types are proposed for the development.

Notice is hereby given that on Monday, July 8, 2019 at 7:00 p.m., in the Council Chambers in the Civic Center, 10 North First Street, Miamisburg, OH  45342, a public hearing will be held by the Board of Zoning, Building and Housing Appeals for the City of Miamisburg, Ohio on an application, being Case No. BZ-07-19, a request for a variance to the requirements of Section 1289.04(e)(3) of the Planning and Zoning Code to allow a 6’ tall privacy fence to extend into the side, corner-side and front yard areas of the property at 701 S. Notice is hereby given that on Monday, July 8, 2019 at 7:00 p.m., in the Council Chambers in the Civic Center, 10 North First Street, Miamisburg, OH  45342, a public hearing will be held by the Board of Zoning, Building and Housing Appeals for the City of Miamisburg, Ohio on an application, being Case No. BZ-08-19, a request for a variance to the requirements of sections 1289.05(e) and 1289.04(g) of the Planning and Zoning Code to allow for the construction of an inground pool on the property at 2202 E. Central Miamisburg, OH 45342 which will be secured by an automatic pool cover and a fence that is proposed to be shorter than the minimum height requirement of 4’. Section 1289.05(e) of the Planning and Zoning Code requires that pools be secured with a fence prior to being filled while Section 1289.04(g) describes the required design for such fences.
